The following Terms & Conditions relate to Triniteq’s PowerEPOS 6 Month Free Promotion, commencing on Thursday August 20, 2020, combined with the ResDiary on-demand webinar offer commencing Monday, February 27, 2023 and finishing 11:59pm March 31, 2023.

Definitions:

  • “Triniteq” – Triniteq International Pty. Ltd., 813 Wellington Street, West Perth, Western Australia, 6005. Head office - 2/46 Paramount Drive, Wangara, Western Australia, 6065.
  • The “Promotion” or “PowerEPOS 6 Months Free Offer” – Triniteq’s Promotion offering eligible Customers access to PowerEPOS POS Software (only), and email support services for up to 6 Months free of charge in line with the Triniteq Terms-of-use, Triniteq’s Privacy Policy and these Terms & Conditions.
  • “Customer(s)” - Includes any business, organisation, entity, or group (such as an entire franchise, or a group including subsidiary business entities) utilising Triniteq’s PowerEPOS Software for business operations in relation to the PowerEPOS 6 Month Promotion and/or Triniteq products and services that directly operate as a part of the Australian Hospitality and/or Retail industries.
  • “Promotional Month” - means a 30-day period during the Promotion Period.
  • "Month' - means a calendar month.
  • “PowerEPOS Software” - Cloud Point-of-sale (POS) software provided by Triniteq.
  • “Promotion Period” – a period of up to six (6) Promotional Months, totalling 180 days, from the moment that the Customer activates PowerEPOS Cloud POS software.
  • “Promotion Conclusion” – The conclusion of the PowerEPOS 6 Month Promotion.
  • “Stripe” – Stripe payment platform used by Triniteq for online billing and payments.
  • “Special Questions” – The questions that the Customer must answer in writing and/or on video, that then must be provided to Triniteq in order for the Customer to be given access to the entire 6 month period of PowerEPOS Software without charge.
  • “Terms & Conditions” – These terms and conditions.
  • “Email Support” – The support of Triniteq products and services via email as dictated by Triniteq’s Terms-of-use

The Customer agrees:

  1. Triniteq will supply eligible businesses and/or organisations (the Customer) with unlimited PowerEPOS Software licenses to use for 6 months, free-of-change (FOC). All Triniteq asks in return is that you, the Customer, adhere to these Terms and Conditions and provide answers to the 4-6 Special Questions through this form. The Customers need to write or upload a video containing their answers to the Special Questions within the Promotion Period. This is so that Triniteq can understand how PowerEPOS Software and Triniteq has performed for your business and also use this information for marketing purposes as per Triniteq’s Privacy Policy.

Approximately 90 days (around 3 months) after you (the Customer) sign-up to the PowerEPOS Promotion, Triniteq will send an email to you (the Customer) to request answers to the Special Questions if they have not already been provided. 

  1. Triniteq reserves the right, in its absolute discretion, to change the Special Questions at any time throughout the Promotion Period.
  1. Triniteq reserves the right, in its absolute discretion, to charge the Customer the full price - $55.00 (Including GST) per Month for the first PowerEPOS license/device, and $35.00 (including GST) per month for each additional PowerEPOS license/device utilised by the Customer from the initial time/day that the Customer accessed or activated the PowerEPOS Software and for the entire period the Customer has access to the PowerEPOS Software if answers to the Special Questions are not provided by The Customer to Triniteq as per these Terms and Conditions.
  1. This Promotion, which is entered into by the Customer and Triniteq, entitles the Customer free-of-charge access to the PowerEPOS (Cloud POS) Software (as defined in the Triniteq Terms-of-use) for a maximum period of six (6) Promotional Months from the moment that the Customer activates such Promotion Period by submitting their Customer and payment details to Triniteq & Stripe. By submitting the Customer’s payment details, the Customer accepts the PowerEPOS 6 Month Promotion Terms & Conditions and (i)consent to Triniteq using the Customer’s details in accordance with Triniteq’s Privacy Policy, (ii) acknowledge and agree to the Triniteq Terms-of-use and these PowerEPOS 6 Month Promotion Terms & Conditions.
  1. If the Customer decides that they do not want to become a paying user of PowerEPOS Software upon the Conclusion of the Promotion Period, the Customer must terminate their PowerEPOS Software and Cloud POS services (by notifying Triniteq Support in writing) 7 days before the end of the Promotion Period.
  1. Eligible Customers may only use this PowerEPOS 6 Month Promotion once. If a Customer is found to have used the PowerEPOS 6 Month Promotion more than once, Triniteq will charge the Customer the total monetary amount for the products and services rendered that are excluded from the initial PowerEPOS 6 Month Promotion Period and these charges will be payable to Triniteq as defined by the Triniteq Terms-of-use.
  1. Triniteq reserves the right, in its absolute discretion, to the fullest extent permitted by law, to not allow any person, business, organisation, entity, or group (such as an entire franchise, or a group including subsidiary business entities) access to this Promotion or to utilise Triniteq’s PowerEPOS software or other Triniteq products and services.
  1. The Promotion will run for a limited time, as directed by Triniteq. The Promotion Conclusion will occur at Triniteq’s complete and absolute discretion. Triniteq reserves the absolute right to conclude the Promotion/Promotion Period without notice.
  1. To be eligible for the Promotion, the Customer must strictly adhere to, be wholly bound by, and act in accordance with, these PowerEPOS 6 Month Promotion Terms and Conditions, along with Triniteq’s Terms-of-use, and Triniteq’s Privacy Policy at all times.
  1. The Customer gives Triniteq full authority to, and agrees to allow Triniteq full and complete use of the Customers answers to the Special Questions for marketing and advertising purposes in accordance with Triniteq’s Privacy Policy.
  1. Triniteq Email Support (only) is included free-of-charge for the entire length of the Customer’s utilisation of the Promotion. Other Triniteq support services such as telephone -, PAYG -, and premium support are chargeable additionally, at Triniteq’s regular support rates. For more information about Triniteq support, please refer to Triniteq’s Terms-of-use.
  1. Customers may opt out (discontinue their use of) of the PowerEPOS Software at any time at no charge as dictated by Triniteq’s Terms-of-use. The Customer can opt out of PowerEPOS without charge by notifying Triniteq Support in writing 7 days before the end of the Promotion Period.
  1. The Promotion is strictly open to Australian registered and operating Retail and Hospitality Customers using PowerEPOS Software, for direct commercial use only. Customers in different locations or operating in different industries shall not be granted access to the Promotion.
  1. Eligible Customers must use the PowerEPOS Software for Retail and/or Hospitality business transactions and reporting only and may not use PowerEPOS in conjunction with this Promotion for any other purpose whatsoever.
  1. To be eligible for the Promotion, the Customer must be an operating Hospitality and/or Retail business entity and must provide Triniteq with a valid Australia Business Number (ABN) associated with the business entity that will be using PowerEPOS Software. This ABN will be verified by Triniteq before the software license(s) is/are granted to the Customer.
  1. To be eligible for the Promotion, a functioning email and (business) postal address must always be supplied by the Customer and kept up to date at all times. Triniteq will not accept liability for costs or claims arising from missing or invalid email addresses. Changes of nominated claimant email address will not be permitted after claims have closed.
  1. To be eligible for the Promotion, the Customer must provide a valid credit (or debit) card to Triniteq’s online payments and billing provider - Stripe. The Customer’s credit (or debit) card must remain valid and hold appropriate funds to cover any incidental changes for the entire Promotion Period and/or as long as the Customer uses Triniteq’s PowerEPOS Software. The Customer should not provide Triniteq with credit (or debit) card information of any kind directly in relation to the Promotion, at any time.
  1. Upon the Customer submitting their credit (or debit) card information to Stripe, the Customer acknowledges and agrees to the Stripe privacy policy, services agreement and terms, along with any other appropriate Stripe terms and conditions.
  1. Triniteq accepts absolutely no responsibility and/or liability in relation to the Customer’s credit (or debit) card information and/or any issues or irregularities associated with Stripe payment platform.
  1. The Promotion includes the following products and services:
  • PowerEPOS POS Software (only).
  1. The Promotion excludes the following products and services:
  • WaiterPOS software
  • WaiterPAD software
  • Sales Manager
  • Stock Manager
  • Time Manager
  • PowerEPOS Insights Reporting Software
  • Predicttile
  • Gift Card Manager
  • All Triniteq hardware
  • All additional Triniteq labour
  • All other Triniteq products and services
  1. This Promotion cannot be used in conjunction with any other Triniteq promotion.
  1. All Triniteq prices noted in these Terms and Conditions are in Australian Dollars (AUD).
  1. Triniteq reserves the right, in its absolute discretion, and to the fullest extent permitted by law, to withdraw or to modify the Triniteq Terms-of-use, or these PowerEPOS 6 Month Promotion Terms and Conditions, and/or Triniteq’s Privacy Policy at any time without prior notice and with no liability.
  1. Triniteq reserves the right to change any terms contained in these Terms and Conditions, or Triniteq’s Terms of use at any time subject to the Relevant State Authorities and/or any other parties who grant the licences.
  1. Changes to Triniteq’s Terms of Use and these Terms and Conditions will be available online, on Triniteq’s website.
  1. If this Promotion is interfered with in any way, if the Customer is found to be ineligible for the Promotion, or if the Promotion is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Triniteq, Triniteq reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; (b) charge the Customer the full price -$55.00 (Inc GST) per Month for the first PowerEPOS license/device, and $35.00 (Inc GST) per Month for each additional PowerEPOS license/device utilised by the Customer from the initial time/day that the Customer accessed or activated the PowerEPOS Software and for the entire period the Customer has access to the PowerEPOS Software; or (c) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  1. Triniteq’s decision is final, and no correspondence will be entered into.
  1. Except for any liability that cannot be excluded by law, Triniteq (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including financial/monetary loss, or loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Triniteq’s control); (b) any theft, unauthorised access or third party interference; (c) any Claim or Payback Credit (or Debit) Card that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Triniteq) due to any reason beyond the reasonable control of Triniteq; (d) any tax liability incurred by a claimant; or (e) use of the Promotion.
  1. Triniteq’s Privacy Policy contains information about how Triniteq will handle the Customer’s personal information, and other information required to be disclosed by the Customer under the Australian Privacy Act. The Customer should read this policy before providing any personal information to Triniteq. Triniteq collects personal information (strictly excluding credit and debit card information which is exclusively collected and stored by, and in accordance with Stripe payments platform/terms) in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, integration partners, and suppliers as required, and to Australian regulatory authorities. Entry is conditional on providing this information. By the Customer supplying Triniteq with personal information for this Promotion, the Customer has given us permission to communicate to the Customer via mail, e-mail, SMS, MMS, Facebook, Twitter, LinkedIn, Instagram, and telephone indefinitely to inform the Customer about Triniteq’s products and services. If the Customer wishes to obtain a copy of Triniteq’s Privacy Policy, access the personal information Triniteq holds about you, the Customer, or if the Customer’s personal information is inaccurate, incomplete or out dated, or to unsubscribe, please contact Triniteq’s Privacy Officer either by email to Triniteq support or by post to Triniteq International Pty.   1. This Promotion and these PowerEPOS 6 Month Promotion Terms & Conditions are upheld, underpinned, and governed by Triniteq’s Terms-of-use.
  1. These PowerEPOS 6 Month Promotion Terms & Conditions are governed by and are to be construed in accordance with the laws of Western Australia. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the courts of Western Australia.

ResDairy On-demand Webinar Offer

  1. Triniteq will waive the monthly $25 (including GST) per site ResDiary platform integration fee for 6 months from the date the PowerEPOS ResDiary integration goes live for eligible businesses and/or organisations (the Customer) when they download the ResDairy Triniteq on-demand Webinar. 
  2. Following the initial 6-month promotional period, Triniteq will bill customers the monthly PowerEPOS ResDiary platform integration fee of $25 per site per month (including GST) from month 7.
  3. Also included in the ResDiary On-demand Webinar offer is free onboarding, set up and training for our PowerEPOS to ResDiary integration.
